By accessing the Site, requesting a quote, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Site or Services.

Binding Agreement: These Terms constitute a legally binding agreement between you and Max’s Real Estate Cleaning.

  • Standard cleaning services
  • Custom cleaning packages

Service Customization: Specific services, pricing, and scheduling will be agreed upon through quotes, contracts, or service agreements prior to service delivery.

Service Area Limitations: Services are currently available in Southern California. Specific service boundaries may apply.


5. QUOTES AND PRICING

5.1 Quote Requests

  • Quotes provided through the Site or by phone are estimates only
  • Final pricing may vary based on property condition, size, and specific requirements
  • Quotes are valid for 30 days from the date of issue unless otherwise specified

5.2 Pricing

  • All prices are in U.S. Dollars (USD)
  • Prices are subject to change without notice
  • Additional fees may apply for services beyond the original scope
  • Travel fees may apply for properties outside our standard service area

5.3 Price Adjustments

We reserve the right to adjust pricing if:

  • The property condition differs significantly from the description provided
  • Additional services are requested during the appointment
  • Access issues or delays occur that are not our fault
  • Hazardous materials or conditions are discovered

You will be notified of any price adjustments before work continues, and you may choose to decline additional services.


6. BOOKING AND SCHEDULING

6.1 Booking Process

  • Services must be booked in advance through our website, phone, or email
  • Bookings are confirmed only when you receive a confirmation email or verbal confirmation
  • We recommend booking at least 48 hours in advance, though we will accommodate urgent requests when possible

6.2 Scheduling Changes

  • You may reschedule appointments with at least 24 hours notice at no charge
  • Rescheduling with less than 24 hours notice may incur a $50 rescheduling fee
  • We reserve the right to reschedule due to emergencies, weather, or unforeseen circumstances

6.3 Cancellation Policy

  • 24+ hours notice: Full refund or credit toward future service
  • Less than 24 hours notice: 50% cancellation fee
  • No-show or same-day cancellation: Full service fee charged
  • Our cancellations: Full refund if we cancel for any reason

7. PAYMENT TERMS

7.1 Payment Methods

We accept the following payment methods:

  • Credit cards (Visa, Mastercard, American Express, Discover)
  • Debit cards
  • Cash
  • Check (with approved credit)
  • Digital payment platforms (Venmo, Zelle, PayPal)

7.2 Payment Timing

  • Residential Services: Payment due upon completion of service
  • Commercial Services: Payment terms as specified in service agreement
  • Large Projects: May require 50% deposit, with balance due upon completion

7.3 Late Payments

  • Invoices are due within 15 days of service completion unless otherwise agreed
  • Late payments may incur a 1.5% monthly interest charge (18% annual)
  • Services may be suspended for accounts more than 30 days past due

7.4 Disputed Charges

If you dispute a charge, you must notify us in writing within 10 days of receiving the invoice. We will investigate and respond within 15 business days.


8. PROPERTY ACCESS AND PREPARATION

8.1 Your Responsibilities

You agree to:

  • Provide safe and legal access to the property at the scheduled time
  • Ensure utilities (water, electricity) are available and functional
  • Secure or remove valuable, fragile, or personal items
  • Disclose any hazardous conditions, mold, biohazards, or special circumstances
  • Ensure pets are secured or removed from work areas
  • Provide accurate property information when requesting quotes

8.2 Access Issues

  • If we cannot access the property at the scheduled time, a $75 trip fee will apply
  • Multiple access failures may result in termination of service agreement
  • You are responsible for providing keys, codes, or lockbox access as needed

8.3 Property Condition

  • We reserve the right to refuse service if the property presents safety hazards
  • Hoarding situations, biohazards, or extreme conditions may require specialized services at additional cost
  • We will notify you immediately if conditions differ significantly from expectations

9. SERVICE GUARANTEE AND QUALITY

9.1 Our Commitment

We are committed to providing high-quality cleaning services. If you are not satisfied with our work:

  • Contact us within 24 hours of service completion
  • We will return to address any issues at no additional charge
  • Re-cleaning must occur within 48 hours of initial service

9.2 Limitations

Our service guarantee does not cover:

  • Issues not reported within 24 hours
  • Damage to items you did not secure or disclose
  • Pre-existing conditions or damage
  • Normal wear and tear
  • Requests beyond the agreed scope of work

10. LIABILITY AND INDEMNIFICATION

10.1 Insurance

Max’s Real Estate Cleaning carries general liability insurance and workers’ compensation insurance as required by California law.

10.2 Limitation of Liability

To the fullest extent permitted by law:

  • Our total liability for any claim shall not exceed the amount paid for the specific service giving rise to the claim
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • We are not liable for damage to items you failed to secure or disclose

10.3 Property Damage

  • Report any damage within 24 hours of service completion
  • We will investigate all damage claims promptly
  • We are not responsible for pre-existing damage or wear and tear
  • Our liability is limited to repair or replacement cost, up to $500 per incident, unless proven to be gross negligence

10.4 Your Indemnification

You agree to indemnify and hold harmless Max’s Real Estate Cleaning, its owners, employees, and agents from any claims arising from:

  • Your failure to disclose hazardous conditions
  • Injuries occurring due to property conditions outside our control
  • Third-party claims related to your property
  • Your violation of these Terms

11. INTELLECTUAL PROPERTY

11.1 Our Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Max’s Real Estate Cleaning or its licensors and is protected by copyright, trademark, and other intellectual property laws.

11.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not:

  • Copy, modify, or distribute Site content without permission
  • Use automated systems to access the Site (scrapers, bots)
  • Remove copyright or proprietary notices
  • Use our trademarks or branding without written permission

16. DISPUTE RESOLUTION

16.2 Mediation

If informal resolution fails, both parties agree to attempt mediation through a mutually agreed-upon mediator in Los Angeles County, California.

17. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Jurisdiction: Any legal action arising from these Terms or your use of our Services shall be brought exclusively in the state or federal courts located in Los Angeles County, California. You consent to personal jurisdiction in these courts.

California Residents: You may have these Terms mailed to you by sending a letter requesting them to our business address.


18. INDEPENDENT CONTRACTOR

Max’s Real Estate Cleaning and its employees or subcontractors are independent contractors. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and the Company.


19. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.


20. WAIVER

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of the Company.


21. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any service agreements, constitute the entire agreement between you and Max’s Real Estate Cleaning regarding your use of the Site and Services, superseding any prior agreements.


22. MODIFICATIONS TO TERMS

22.1 Right to Modify

We reserve the right to modify these Terms at any time. When we make changes:

  • Material changes will be communicated via email or Site notice
  • Continued use after changes constitutes acceptance

22.2 Your Options

24. SURVIVAL

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: payment obligations, liability limitations, indemnification, dispute resolution, and governing law.
